Touched By Anjail LLC
Returns & Refunds
1. Scope and Acceptance
This Returns and Refunds Policy (this “Policy”) governs returns, replacements, cancellations, and refunds for goods, Digital Products, Publications, and services offered by Touched By Anjail LLC, a Georgia limited liability company, together with En’Zakiyyah and its associated brands (the “Studio”). By placing an order, booking a service, or completing a purchase, you acknowledge that you have read this Policy and agree to be bound by it.
This Policy operates together with the Studio’s Usage Rights and Reserved Interests notice (the “Usage Rights”). Capitalized terms not defined in this Policy, including “Studio Work,” “Publication,” “Edition,” “Tier,” and “Digital Product,” have the meanings given in the Usage Rights. A refund restores the purchase price only; it does not convey, preserve, or extend any license.
2. Purchase Channels
The Studio offers work directly and through independent third-party platforms. Where an order is processed or fulfilled by a third-party platform, that platform’s terms govern the transaction together with this Policy, and that platform may exercise its own refund discretion independently of the Studio.
Regardless of the purchase channel, you may contact the Studio first. The Studio will identify the remedies available, specify the evidence required, and, where appropriate, coordinate with the applicable fulfillment partner on your behalf.
3. Printed Goods
This section applies to apparel, drinkware, calendars, printed Publications, and other items produced to order.
Eligible Claims
- The item arrived damaged.
- The item is misprinted, misaligned, or otherwise defective in manufacture.
- The item or variant received differs from the item or variant ordered.
Ineligible Claims
- A change of mind after the order is placed.
- An incorrect size, color, or design selected at checkout.
- An item that has been worn, washed, altered, or damaged after delivery.
- Failed delivery resulting from an incomplete or incorrect address supplied by the purchaser. A replacement may be arranged at the purchaser’s expense.
Reporting Procedure
A claim must be submitted within seven (7) days of delivery and must include the order number and clear photographs of the defect. Unless the Studio requests otherwise, the item need not be returned. Upon acceptance of a claim, the Studio will provide, at its election, a replacement or a refund of the purchase price.
Claims submitted after the reporting period are not eligible. The Studio may, in its sole discretion, consider a late claim where the purchaser demonstrates that delivery was delayed or that the purchaser could not reasonably inspect the item within the reporting period. Consideration of one late claim does not waive the reporting period for any other claim.
4. Works on Canvas
Canvas pieces are printed reproductions of original artwork, produced and shipped to order. They are not unique physical originals, and no canvas piece is represented as such. Delivery estimates of seven (7) to ten (10) days are estimates only and are not guaranteed. Claims for canvas pieces are handled by the Studio directly.
Eligible Claims
- The piece arrived damaged in transit.
- The print is defective, including streaking, misalignment, tearing, or improper stretching.
- The piece or size received differs from the piece or size ordered.
Ineligible Claims
- A change of mind, or a determination that the piece does not suit the intended space.
- Minor variation in color between an electronic display and a printed surface. Backlit screens cannot be matched exactly by any print process.
- Damage occurring after delivery, including during hanging or framing.
Reporting Procedure
A claim must be submitted within three (3) days of delivery and must include the order number, clear photographs of the piece, and photographs of the outer packaging if the packaging was damaged. The purchaser must retain all packaging until the claim is resolved. Upon acceptance of a claim, the Studio will provide, at its election, a replacement or a refund of the purchase price.
The reporting period is limited because a claim must be raised while the piece and its packaging can still be assessed. The late-claim discretion described in Section 3 applies equally to canvas pieces.
5. Digital Products and Publications
Digital Products, digital Publications, editable templates, kits, checklists, content logs, companion audio, and other electronically delivered Studio Works are delivered immediately upon purchase and cannot be returned once access has been granted. All sales of Digital Products are final. By completing the purchase, you request immediate delivery and acknowledge that access cannot be revoked or returned once granted.
Defective Delivery
If a file fails to download, is corrupted, or is not the file described in the product listing, notify the Studio within fourteen (14) days of purchase. The Studio will supply a working copy of the correct file or, if it cannot do so, refund the purchase price.
No Refund Is Owed Where
- the Digital Product has been downloaded, opened, copied, or accessed, and is not defective;
- the purchaser selected the wrong Tier, Edition, or format at checkout;
- a later, revised, or superseding Edition is released after purchase;
- content designated as provisional, current-season, or within a stated observation window is subsequently updated by its sources;
- the purchaser lacks compatible software, an account with a third-party service, or the technical ability to use the files, where requirements were stated in the product listing; or
- the purchaser’s use of templates, sample disclosures, or client-ready language does not produce a particular legal, regulatory, platform, or commercial result. Such materials are not legal advice, as stated in the Usage Rights.
Tiers and Upgrades
A purchase at one Tier may not be exchanged for a refund at another Tier. Where the Studio offers an upgrade, the purchaser pays the applicable upgrade price stated at the time of the upgrade, and no partial refund is issued for the lower Tier previously purchased.
Effect of a Refund
If a refund is issued for any Digital Product, the license granted with it terminates immediately in accordance with the Usage Rights. The purchaser must cease all use of the Digital Product and permanently delete all copies, including copies placed in shared drives or adapted into templates, except completed client materials lawfully delivered before the refund.
6. NFTs and Blockchain Purchases
Transactions recorded on a blockchain are irreversible and cannot be reversed by the Studio, a marketplace, or any other party. All NFT sales are final. No refunds, cancellations, or exchanges are available.
Before purchasing, you acknowledge that:
- you are acquiring a digital collectible. Nothing offered by the Studio is an investment, a security, or a representation of future value;
- the Studio does not control resale prices, marketplace conduct, wallet software, network or gas fees, or the availability of any third-party platform;
- assets sent to an incorrect wallet address cannot be recovered; and
- unless expressly stated in writing at the point of sale, the purchase does not transfer copyright or commercial rights in the underlying artwork, which remain subject to the Usage Rights.
7. Officiant Services
A retainer is required to reserve a ceremony date. The retainer is non-refundable and is earned upon receipt, because the Studio declines all other engagements for the reserved date and that opportunity cannot be recovered if the booking is cancelled.
- The remaining balance is due in advance of the ceremony, on the schedule set out in the booking agreement.
- Upon cancellation by the client, the retainer is retained. Any balance paid and not yet earned will be refunded.
- One change of date may be accommodated, subject to availability, without an additional retainer. A second change of date, or a requested date that cannot be accommodated, is treated as a cancellation by the client.
- If the Studio is unable to perform the ceremony for any reason within its control, the client will receive a full refund of all amounts paid, including the retainer, and the Studio will make reasonable efforts to assist in locating a qualified replacement officiant.
- Neither party is liable for a failure to perform caused by events beyond its reasonable control, including natural disaster, severe weather, public-health orders, or serious illness. In that event, the parties will work in good faith toward a new date or an equitable settlement.
Where a signed booking agreement conflicts with this Policy, the booking agreement governs.
8. Brand, Visual, and Commissioned Services
Commissioned work is produced to the client’s specifications and is therefore governed by terms different from those applicable to goods.
- A deposit is required before work begins. The deposit is non-refundable because it reserves Studio time that becomes unavailable to other clients.
- If a project is cancelled by the client after work has commenced, the deposit is retained and any work completed in excess of the deposit is invoiced at the agreed rate.
- Usage rights in final approved deliverables are granted only upon payment in full and only to the extent stated in the project agreement and the Usage Rights. Concepts, drafts, and working files that have not been paid for remain the property of the Studio and may not be used.
- Dissatisfaction with a creative direction is addressed through the revision rounds agreed at the outset and does not constitute grounds for a refund of work already delivered.
- If the Studio withdraws from a project before completion, the client will be refunded for any work paid for and not delivered.
Where a signed project agreement conflicts with this Policy, the project agreement governs.
9. Changes and Cancellations of Orders
Made-to-order items enter production promptly. A request to change or cancel an order must be submitted immediately. The Studio will stop the order where production has not begun; once production has begun, an order may not be cancelled or altered.
The purchaser is responsible for the accuracy of the delivery address entered at checkout. A delivery address cannot be amended after an item has shipped.
10. Disputes and Chargebacks
Before initiating a dispute with a bank or card issuer, the purchaser agrees to contact the Studio and allow a reasonable opportunity to resolve the matter. Most matters can be resolved directly and more quickly than through a payment dispute.
A chargeback filed without first contacting the Studio, or filed for circumstances this Policy does not cover, will be contested with all available evidence, including delivery confirmation, download and access records, and the purchaser’s acceptance of this Policy and the Usage Rights. Upon the filing of a chargeback, any license associated with the disputed purchase terminates in accordance with the Usage Rights. The Studio reserves the right to decline future orders and bookings from any account with an unresolved or fraudulent dispute.
11. Statutory Rights
Nothing in this Policy excludes, restricts, or modifies any right or remedy available to a consumer under the laws of the State of Georgia or the United States that cannot lawfully be excluded, restricted, or modified. Where any provision of this Policy conflicts with such a right, that right prevails, and the remaining provisions continue in full force and effect.
12. Governing Law and Venue
This Policy is governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. Any dispute arising from this Policy shall be brought exclusively in the state or federal courts located in the State of Georgia, and the parties consent to the personal jurisdiction of those courts.
The Studio sells to customers within the United States.
13. Amendments
The Studio may amend this Policy from time to time. The version in effect at the time an order is placed or a booking is confirmed governs that order or booking.
Submitting a Claim
Submit claims in writing and include your name, order number, purchase date, and a description of the issue. Where applicable, include clear photographs of the item, packaging, or defect, or a description of the download error.
