Usage Rights and Reserved Interests

Applicability and Controlling Terms

These Usage Rights apply to artwork, portraits, sigils, illustrations, designs, written materials, digital files, audiovisual content, physical products, concepts, templates, brand materials, and other creative content offered through TouchedByAnjail.com or a linked storefront.

A product listing, proposal, invoice, license, or signed project agreement may provide different or additional terms. When specific written terms conflict with this notice, the specific written terms control for that product or project.

No right, license, ownership interest, or permission is granted by implication, silence, purchase alone, or prior conduct.

Ownership and Intellectual Property

All copyrightable elements of original creative works created by, owned by, or licensed to En’Zakiyyah and/or Touched By Anjail LLC remain the property of their applicable owner. This includes original selection, arrangement, art direction, editing, written expression, composition, branding, and other protectable creative contributions.

Purchasing or receiving a physical item, digital file, or service deliverable does not transfer copyright, trademark rights, publicity rights, source files, or ownership of the underlying intellectual property unless a separate written agreement expressly states otherwise.

Physical Artwork and Products

After full payment, the purchaser owns the particular lawfully purchased physical item and may display, gift, or resell that specific item. Ownership of that physical item does not include ownership of the artwork or any reproduction rights.

Without prior written permission, the purchaser may not:

• copy, scan, trace, reproduce, or manufacture additional copies of the work;
• sell prints, merchandise, downloads, tokens, or other reproductions;
• extract or reuse visual elements in a logo, brand, advertisement, product, or campaign;
• claim authorship, copyright ownership, sponsorship, or endorsement; or
• use photographs or recordings of the work primarily to create a competing product.

A purchaser may truthfully identify the creator when displaying or reselling the particular physical item but may not imply an ongoing affiliation, authorization, or endorsement.

Digital Works and Downloads

Unless a listing or written license states otherwise, a digital purchase grants the purchaser a limited, non-exclusive, non-transferable, and non-sublicensable license for personal, non-commercial use only.

The original downloadable file may not be shared, forwarded, uploaded for others, resold, relicensed, distributed, posted as a downloadable asset, placed in a stock library, used in print-on-demand production, or made available through a public or shared template.

Any permitted printing, device use, or personal sharing is limited to what is expressly stated in the applicable product listing or written license.

Commercial and Exclusive Rights

Commercial use, sublicensing, exclusivity, copyright ownership, merchandising, advertising use, mass production, or use on products for sale requires a separate written license or project agreement.

Any commercial or exclusive grant is limited to the deliverable, purpose, media, territory, duration, quantity, and other conditions expressly identified in that agreement. Payment alone does not create commercial, exclusive, or ownership rights.

Custom and Client Work

Rights for logos, brand visuals, landing pages, commissioned artwork, and other client services depend on the individual project. The applicable proposal, invoice, license, or signed agreement determines whether the client receives a limited license, commercial rights, exclusive rights, or ownership.

Unless project-specific terms expressly state otherwise:

• no usage rights are granted until payment is received in full;
• after full payment, the client receives a limited license to use the final approved deliverables for the agreed project or business purpose;
• drafts, rejected concepts, unused variations, source files, working files, templates, methods, and process materials remain with Touched By Anjail LLC and/or En’Zakiyyah;
• rights apply only to final approved deliverables and do not extend to underlying tools, licensed materials, fonts, stock elements, or third-party content; and
• alterations made by the client or a third party are not the responsibility of the studio and may not be represented as the studio’s unaltered work.

The studio may display non-confidential completed work in its portfolio, website, social channels, proposals, and promotional materials unless a signed confidentiality agreement or project-specific term states otherwise. Work containing private information or a protected likeness will be displayed only when the necessary permission or release has been obtained.

Clients are responsible for confirming that they have permission to provide and use all names, photographs, copy, logos, music, footage, trademarks, and other materials supplied to the studio.

Name, Image, Voice, and Likeness

No purchase, download, commission, website visit, or access to studio content grants permission to use the name, professional name, image, portrait, photograph, video, voice, signature, biography, persona, or likeness of En’Zakiyyah, studio personnel, clients, models, or any other depicted person.

Without prior written consent, these identity elements may not be used to advertise, promote, imply endorsement, impersonate, create an avatar or digital replica, clone a voice, generate synthetic media, create a deepfake, or support any commercial, political, defamatory, misleading, or exploitative purpose.

Artificial Intelligence and Data Use

Unless expressly authorized in writing, studio artwork, designs, writing, audiovisual materials, source files, brand materials, and protected identity elements may not be uploaded, submitted, scraped, copied, or used:

• to train, fine-tune, test, benchmark, or build an artificial-intelligence or machine-learning system;
• as part of a dataset, model, prompt library, reference library, or automated content system;
• to generate derivative, competing, or substantially similar content;
• to imitate a distinctive brand identity or falsely attribute output to the studio; or
• to create an avatar, facial replica, voice clone, synthetic performance, or other digital replica.

Brands and Source Identification

Studio names, professional names, collection names, logos, emblems, slogans, trade dress, and other source-identifying brand elements may not be copied, registered, incorporated into another brand, used in a domain or social-media handle, or used in a way that suggests affiliation, sponsorship, approval, or endorsement without prior written permission.

Spiritual and Ceremonial Language

References to energetic cleansing, intention, symbolism, mysticism, spiritual use, metaphysical use, or ceremonial preparation describe the artistic, cultural, personal, or spiritual character of the work. They do not guarantee a particular result or outcome.

Products, artwork, and creative services are not substitutes for medical, psychological, legal, financial, or other licensed professional advice, diagnosis, or treatment.

External Stores and Platforms

Purchases made through a linked marketplace or external storefront are subject to that platform’s transaction, payment, shipping, return, and customer-service terms. These Usage Rights continue to apply to the creative content unless the product listing or a separate written license expressly grants different usage rights.

Unauthorized Use and Enforcement

Unauthorized use may result in a request to stop the use, remove the material, preserve relevant records, provide an accounting, or resolve the matter through an appropriate license. Touched By Anjail LLC and the applicable rights owner reserve the right to submit platform notices and pursue any remedies available under applicable law.

A failure or delay in enforcing a right does not waive that right. If any provision of these Usage Rights is found unenforceable, the remaining provisions will continue to the fullest extent permitted by law.

Notice Updates

These Usage Rights may be updated to reflect changes in studio offerings, platforms, technology, or applicable requirements. The effective date identifies the current version. Material changes apply prospectively unless a different effective date is stated or applicable law requires otherwise.
